Can a tenancy agreement be broken because of an infestation of Bed Bugs that has come from the flat above?
Short answer – “No!”
Unless I suppose the landlord was responsible for the flat upstairs. Otherwise it is not the landlords fault what your upstairs neighbours do.
If you report the matter to the Environmental Health dept at your local authority and they do a Housing Health and Safety Rating System survey, they may be minded to class it as a category 1 hazard and order your landlord to do something about it, but I cannot guarantee this.
But even if they do, this will not allow you to end the tenancy and move out. In fact you would not normally be entitled to do this even if he WAS responsible. So you certainly can’t if he is not.
