Here is a question to the blog clinic from Catherine who lives next door to a rented property
The house next door to me is privately owned and let to students through a letting agent.
The fence panells to the rear garden blew down and I have written to the agents asking for them to be replaced and enclosed plans proving its thier landlords responsibility but he has refused to replace them …. what can i do ??
Sadly Catherine, the answer is probably ‘Not at lot’. Your legal remedy would be to apply to the court for an injunction but that would be totally over the top and the Judge may not be prepared to grant it anyway.
However I suspect that the panels will be replaced, but just not now. When the time comes for the property to be re-let, the landlord will want it to look its best, and it is then that the panels will probably be done, if they are going t be done at all.
Fence panels are not Landlord responsibility under s11 Landlord and Tenant Act 1985
I always thpought they were but have recently had it pointed out to me that they are not.
