The Landlord Law 2017 New Year Survey

This post is more than 8 years old

January 9, 2017 by Tessa Shepperson

Take our survey

We have a lot of plans for things to do in 2017 – but in order to be sure that we are targeting the right things, I need your help.

I need feedback on the things that worry you and the problems you have.

I have therefore set up a survey for you.  And as a ‘thank you’, on completion of the survey you will be re-directed to a page where you can download a free ebook with a selection of ten of the best blog posts of 2016.

The survey should not take you long to do.  To go there please click the button below:

    Hi Tessa,

Thank you for your latest blog.

Re your quote: “Government and the authorities consider landlords to be providers of a consumer service” ….Indeed, indeed, yes, landlords ARE providing a service!….IE running a business with huge penalties for default (as you rightly say “ignorance of the law is never a defence”) etc, so how can it possibly be legal that landlords are instead treated like investors for tax? Is this not against our human rights? Are not the HMRC breaching their own codes/definitions/tests of the difference between an investment and a business?

    Yours sincerely,

    Steve

A lot of landlords, as I can see from the survey results so far, are extremely unhappy about the way they are treated for tax.

I think however you would have an uphill battle challenging tax on the basis of the human rights legislation – the recent challenge to the new rules brought by two landlords failed partly on this point I think.

The business / investor point is a good one but I don’t do tax and this blog is not really about tax.

It is something you should raise with your MP. If ALL landlords contacted their MP about it there would be a better chance of something being done.
