The Rakusen v. Jepson Supreme Court Decision – watch our webinar with Barister Robert Brown

This post is more than 3 years old

March 10, 2023 by Tessa Shepperson

As promised last week, our free webinar with housing barrister Robert Brown took place this morning.

Robert represented the National Residential Landlords Association in the case of Rakusen v. Jepson which was all about who is liable for rent repayment orders – is it just the immediate landlord or can an order be made against the superior landlord where there is a ‘rent to rent’ arrangement in plaace.

The Court of Appeal found for the superior landlord last year (which we discussed here)  and the Supreme Court followed that decision.  In essence, they found that a rent repayment order can only be made against the immediate landlord – as that is the landlord the rent was paid to.  The rent was not paid to the superior landlord, so he cannot ‘repay’ it.

In this fascinating webinar, Robert looks at rent to rent and what it is, and rent repayment orders and the rules surrounding them.  Before going on to discuss the Supreme Court’s decision and reasoning.  Watch the webinar below:
