3. Which of the following statements regarding the landlords right of entry is incorrect?
- The landlord can always enter the property in case of emergeny
- The landlord cannot enter the property if the tenant has refused permission
- The landlord can always enter the property if he has given 24 hours written notice
- If the tenant refuses to allow the landlord access to view the property condition this will usually put him in breach of the terms of his tenancy agreement
Mind you this is a bit of a moot point but virtually all lawyers will agree that if a landlord enters a property against the express wishes of the tenant – this will be trespass, whether or not he has served 24 hours notice.

4. Accordingly to reports, which of the following is an unexpected problem caused by the Green Deal?
- Too many people are signing up to it and funds are running out
- There is a danger of people, particularly the elderly, dying from overheating caused by living in super-energy efficient homes

5. Are all adults named on the tenancy agreement entitled to receive their own set of keys by law?
- Yes
- No
In fact there is no specific law on this point, so it will depend on the terms of the contract and what the parties agree.

6. Which of the following statements is incorrect regarding guarantees?
- The guarantor cannot normally avoid liability during the fixed term of the tenancy
- The guarantor’s liability under the guarantee will end if the rent goes up without a new guarantee being signed
- A guarantor can end their liability at any time on giving two months notice
- Guarantors are entitled to recover any money paid by them to the landlord, from the tenant
Actually, when the guarantor can end the guarantee will probably depend on the terms of the guarantee deed. But almost certainly it will last for the fixed term – unless the terms of the guarantee are changed.

7. Which of the following statements is untrue regarding changing managing agents?
- The agent is legally entitled to manage the property while the tenant they found is living in the property
- The landlord or his new agent must give notice to the tenants informing them of the situation and giving new payment details
- The old agents must forward any money paid to them by the tenants on to the landlord
- A tenant’s obligation to pay rent will not be satisfied if they continue to pay to the old agent after being given notice of the change

Both the landlord and the tenant are bound by the tenancy agreement as it was at the time the property was sold – except landlords by purchase have fewer rights eg to evict the tenants.
