Arla and Fixflo have come up with this rather nice infographic showing the workings of the new retaliatory eviction rules.
As you should by now be aware – these will apply just to assured shorthold tenancies in England which are created or renewed on or after 1 October 2015 (or, if you are reading this after 1 October 2018,to all ASTs).
The infographic shows how the rules should work and how I very much hope that they will be shown to work.
However, as I indicated in my previous post, I have reservations as to whether the wording of the statute actually has the effect shown in scenario 5.
But isn’t it scandalous that after all the problems we have had with the deposit legislation, the Parliamentary draftsmen are still churning out unclear wording?
